Driver high on cannabis: court told


A man accused of negligently causing a car accident which claimed the life of his wife was allegedly high on cannabis at the time, a court has heard.

But Troy Anthony Wilson's lawyer maintains the defendant swerved to avoid a kangaroo seconds before the crash on a winding rural road.

The 38-year-old appeared in the ACT Magistrates Court today charged with negligent driving occasioning death.

Wilson has pleaded not guilty the charge, and denies having consumed cannabis in the day leading up to the incident.

His wife of 18 years, Lisa Jane Wilson, died in the crash on Paddy's River Road in September 2009.

Wilson was driving at the time.

The pair were returning from a family barbecue at Cotter about 7pm on September 13.

The defendant's four children and his cousin's two children were also in the blue Mitsubishi Pajero at the time, and suffered minor injuries.

The court heard a screening test conducted about two hours after the incident returned a high reading for THC, the active ingredient in cannabis.

But Wilson, from the witness box, said he had not consumed cannabis since the previous evening.

Magistrate Peter Dingwall adjourned the hearing until Thursday.
